A trustee’s letter says money from a foreclosure sale is waiting on a claim. A landlord’s lawsuit was posted on the door. A parent has died without a will, or a customer has stopped paying. Fred Yadegar is a Los Angeles attorney who takes on each of these matters for clients in Los Angeles County and Orange County, and the work is done by him rather than by a department.

The week after something goes wrong

The first days after a crash, a foreclosure sale, or a served notice decide more than most people realize. Insurance carriers assign an adjuster immediately and begin building a file while you are still seeing doctors. A foreclosure trustee mails a single notice about surplus money, often to the address you just lost, and the 30-day claim window runs from that mailing. An unlawful detainer summons allows 10 court days for a written response, after which the landlord may ask the court for a default judgment.

Fred’s first job on any new matter is to identify the clock that is running and keep it from running out. That usually happens in the first conversation, before any paperwork is signed.

Five areas, one office

The practice concentrates on five kinds of matters, and clients often need more than one at a time. Injury law covers car, rideshare, and pedestrian collisions, falls on someone else’s property, serious injuries, and the disputes with insurers that follow. Surplus funds recovery returns the money left over after a trustee’s sale to the former owner or the heirs. Eviction defense answers unlawful detainer lawsuits for tenants and for former owners still living in a foreclosed home. Wills and trusts work covers planning, reviewing documents already signed, and enforcing them when a trustee falls short. Breach of contract work covers unpaid invoices, contractor disputes, collapsed real estate deals, and defending you when someone claims you broke an agreement.

A foreclosure that leaves surplus money on the table often comes with an eviction notice in the same month. A death in the family can turn a trust question into a probate question. Because all five areas sit in one office, the overlapping pieces are handled together instead of being split among firms that do not talk to each other.

Deadlines that decide cases

California gives most injury claimants two years from the date of injury to file suit (Code Civ. Proc. §335.1), and only six months to present a written claim when a city, county, or transit agency is responsible (Gov. Code §911.2). A surplus-funds claim must be signed under penalty of perjury and submitted within 30 days of the trustee’s notice (Civ. Code §2924j). A tenant served with an unlawful detainer has 10 court days to respond (Code Civ. Proc. §1167). Written contracts carry a four-year limit and oral agreements two (Code Civ. Proc. §337, §339). Each of these has exceptions that can shorten or extend it, which is why the injury law pages and every other practice page on this site repeat the same advice: call before you assume you have time.
